La loi sur la responsabilité des Polonais dans la Shoah modifiée en urgence

Dans la matinée du 27 juin 2018, le Premier ministre polonais Mateusz Morawiecki a demandé de compléter l’ordre du jour de la Diète par un amendement à la loi sur l’Institut de la mémoire nationale, en d’autres mots: la loi controversée sur le déni de la responsabilité des Polonais concernant les crimes organisés par le Troisième Reich, adopté par le Parlement polonais le 26 janvier 2018.

Le gouvernement souhaitait supprimer la partie pénale de la loi, qui peut « détourner l’attention de l’objectif initial » de la législation, ce dernier étant la protection du « bon nom » de la Pologne. L’amendement a été adopté dans la même journée par les voix du parti au pouvoir, ce qui signifie que personne ne pourra être poursuivi pour avoir suggéré la participation des Polonais dans le crime du Holocaust.

A ce jour, quelques plaintes contre des médias internationaux ont été déposées depuis janvier par des organisations extrémistes en Pologne, mais aucune n’a été acceptée par le procureur.

Law about Poles’ responsibility in the Holocaust amended

In the morning of June 27, 2018, the Polish Prime Minister Mateusz Morawiecki requested to add to the agenda of the Polish Parliament an amendment to the law regarding the Institute of National Remembrance – the controversial « Holocaust Law » accepted by the Polish Parliament on January 26, 2018.

The government declared its will to cancel the penal part of the existing law, as it « may divert attention from its initial goal » (i.e. the protection of the « good name of Poland »). As stated, this means that no-one will be sued for suggesting the participation of Poles in the crime of Holocaust. The amendement was adopted on the very same day, in an unusual emergency, by the governing majority.

Since January, a few Polish extremist organisations attempted to file complaints against international media in the name of the law quoted above. None of these complaints resulted in a lawsuit.
